Terms of Service

Last updated: 13 October 2026

0. Service provider

MemoFlash is operated by Andrea Libutti — sole proprietorship "LIBUTTI ANDREA"
Italian VAT number 18598921007
Registered office: Via Riva Ligure 44 — 00163 Rome (RM), Italy
General contact: info@memoflash.app · Support: support@memoflash.app.

1. Acceptance

By using MemoFlash you accept these terms. If you disagree, do not use the service.

2. Account

You must be at least 14 years old to use MemoFlash, and you declare it when you sign up. You are responsible for the confidentiality of your credentials.

3. Subscriptions

MemoFlash offers a free plan (Free) and paid plans (Basic, Plus). Subscriptions are purchased through the App Store or Google Play, which handle payment, billing and refund requests under their own terms, and they renew automatically until you cancel.

You cancel a subscription in the store you bought it from: on iPhone under Settings → your name → Subscriptions, on Android in Google Play → Payments & subscriptions. Deleting your account or uninstalling the app does not cancel your subscription.

The first month may come at a promotional price (in Italy €1.99 for Basic and €4.99 for Plus): it applies once only, and only if the store considers you eligible. On iPhone it covers Basic and Plus together: if you already had it with one of them, the other starts at full price. From the second month the standard price of the plan applies (in Italy €4.99 and €7.99 per month). In other countries, the price the store shows before you buy is the one that applies.

4. User-generated content

The decks and flashcards you create remain yours. You grant us a limited licence to store, sync, and serve them as part of the service.

If you share a deck or a folder with a link, anyone with the link can read its content, even without an account, until you revoke the share; anyone who has already imported it keeps their copy, which still shows your name as the author. Anyone who has your friend code can add you as a friend, without you having to accept: your friends see your name, avatar, level, streak, weekly points and your recent activity (the names of the decks you study, scores, milestones, completed challenges).

5. Acceptable use

MemoFlash may not be used for illegal, hateful, pornographic or rights-infringing content. We reserve the right to suspend accounts that violate this.

6. AI Studio

AI-generated flashcards are a study aid, not a source of truth. Always verify content before using it for exams or important decisions.

7. Limitation of liability

MemoFlash is provided "as is". To the extent permitted by law, MemoFlash is not liable for indirect damages, data loss, or academic outcomes.

8. Changes

We may update these terms. We will notify you by email at least 30 days before substantive changes.

9. Governing law

These terms are governed by Italian law. For disputes involving users who qualify as consumers, jurisdiction lies non-derogably with the courts of the consumer's place of residence or domicile, pursuant to Article 66-bis of the Italian Consumer Code (Legislative Decree 206/2005), reflecting the protection afforded by EU consumer law. For non-consumer users, the exclusive venue is Rome.

10. Digital Services Act (Reg. EU 2022/2065)

Pursuant to the Digital Services Act, MemoFlash designates the following electronic points of contact:

  • Competent authorities and the Commission (Art. 11): dsa@memoflash.app — accepted languages: Italian, English.
  • Recipients of the service (Art. 12): support@memoflash.app.
  • Reporting allegedly illegal content in shared decks (Art. 16 — notice and action mechanism): abuse@memoflash.app. Notices must provide a sufficiently substantiated explanation of the reasons the content is considered illegal, its location (e.g. the shared-deck link) and the contact details of the notifier.

In accordance with Art. 17 DSA, whenever we restrict the visibility of, suspend or remove content or an account for breach of law or of these terms, we provide — where technically feasible — a clear statement of reasons to the affected recipient of the service, including the legal or contractual ground applied and the redress options available.

11. AI transparency (Reg. EU 2024/1689 — AI Act)

MemoFlash's automatic flashcard generation feature relies on generative AI models provided by Google (Gemini). Google is the provider of the AI system under the AI Act; MemoFlash acts as downstream deployer.

  • Decks created with AI are marked in the app with the “✨ AI” symbol, so that you can tell them apart from the ones created by hand (Art. 50 AI Act — transparency obligation on synthetic content).
  • AI-generated flashcards are a study aid: they may contain errors, inaccuracies or "hallucinations" typical of generative models. Always verify the content before using it for exams or important decisions.
  • You can disable the AI feature at any time from Profile → Privacy & Data: MemoFlash will remain fully usable for manual flashcard creation and study.
  • We do not use AI for automated decision-making that produces legal effects or similarly significant effects on the user (Art. 22 GDPR).
